Five Questions To Ask When Hiring A Criminal Defense Attorney
1. How much experience do they have in the area of criminal law?
Do they practice law in other areas? (Family Law, Bankruptcy, or Civil Litigation?) You want to make sure that your attorney has an understanding and passion for criminal defense work. You need someone dedicated to the practice of criminal defense work spending their time working on your case. A great criminal defense attorney can strategize and inform the client of possible motions or other avenues that can be beneficial to the client during the initial consultation.
2. Does the attorney have a knowledge of this particular courthouse, judge or prosecutors?
Having a local attorney with knowledge of the judges and prosecutors can be vital to getting the best result in your case. When the attorney personally knows the local judges, rules and prosecutor, he or she can obtain a better result for you in many cases. When you have an attorney who knows the court procedures, this can be a great advantage to you and your case. Any attorney can tell you they handle criminal cases, but in most cases, it will be beneficial for you to have an attorney who has handled similar cases in the past.
3. Who will be handling my case?
You might need to ask who will be the attorney that will be handling your case. Some criminal defense firms cite their team of attorneys or how many years of experience they have, but many times you don’t meet the actual attorney who will be handling your case during the initial consultation. Unfortunately, after you hire the firm, your case and life gets handed off to a junior attorney who obviously doesn’t have the knowledge and skill of a senior partner. You should always meet with and talk to the actual attorney who will be handling your case in court. Find someone you feel comfortable with, and who will handle your case to the end.
4. How well does the attorney communicate with his current and past clients?
A general rule is that even a busy attorney should be able to get back to you within 24 hours. Usually, the attorney can text or email you from his phone or computer within minutes. You need to know you can reach your attorney, and that they will get back to you within a reasonable time to ease whatever concerns you may have. You want them to be able to explain, use examples, and relate to you as they speak so you can always be on the same page.
5. Do they have client testimonials?
A great criminal defense attorney will usually have many stories of great outcomes in cases that they have handled in the past. While this can provide a little comfort, it shouldn’t be a promise or guarantee of a similar result in your case. But, a criminal defense attorney who cannot give examples of excellent outcomes in a similar situation with a past client might not have the experience you need for your particular case.
