PC 211 Robbery

Robbery is the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear.

California Penal Code Section 211 defines robbery as the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear. Robbery is what is known as a “strike”.

Depending on the circumstances and whether the robbery is considered a first degree or second degree robbery, the punishment could be as much as 9 years in prison. If a weapon is used in the commission of the crime, enhancements could add additional prison time.  

In Orange County, recently sheriff deputies have made an arrest in connection with a home invasion robbery that occurred last week after two suspects held an elderly woman inside her home, while they searched it for items they could steal. After speaking with the woman, the officers had released a sketch of one of the men who participated in the armed robbery. After some quick investigation, a picture lineup was conducted, and the victim positively identified the suspect.

The elderly woman was tied to a chair and her head was covered with a towel during the incident. Apparently, the men were seen leaving the area in a pickup truck.
